Weir Bowen LLP - Steps In a Civil Action - Service of Experts' Statements

A party intending to adduce the evidence of experts at trial must serve, on all other parties to the action, statements of the substance of the evidence of the experts upon which the party intends to rely at trial.

In cases where the trial will take 25 days or less, the statements of experts must be served not less than 120 days before trial, and the statements of experts to be called to rebut the evidence of other experts must be served not more than 60 days after service of the documents of the experts whose evidence will be rebutted.

In cases where the trial will take more than 25 days, the case management judge may make directions as to when the statements of experts must be served.
