Weir Bowen LLP - Steps In a Civil Action - Notices To Admit

A party can serve a notice requesting any other party to admit a fact (or facts), for the purposes of the action only. The fact will be deemed to be admitted, unless the other party serves a statement objecting to the notice or specifically denying the fact with a reason for the denial (within 30 days after service of the notice).

An objection to a notice to admit can be made on the grounds that the notice requests an admission of a fact that is irrelevant or privileged or that the request is improper for some other reason.

Where a party refuses to admit a fact that is proved at trial, the cost of proving the fact will be paid by the party who refused to make the admission regardless of the result of the action, unless the court finds that the refusal was reasonable.
